The Turkish government takes an important decision to facilitate real estate sales transactions

The Turkish Minister of Justice, Yilmaz Tunç, announced that notary offices (noter) in Turkey are now officially authorized to complete real estate sale transactions and property title transfer transactions. The minister stated that the government decision will come into effect starting from July 4, 2023.

It is worth noting that the decision to complete real estate sales in Turkey through notary offices has been on the Turkish government's table for several months, but its official adoption was delayed until easier and safer executive mechanisms could be organized and developed.

Real estate sale transactions have become easier and smoother

In another part of his statement, Mr. Tunç confirmed that the decision to complete real estate sale transactions and property title transfers through notary offices is of great importance, as it saves time for clients by allowing them to complete their own transactions related to buying, selling, and transferring property titles at notary offices spread across all Turkish provinces, instead of crowding at land registry directorates, which are packed with clients wishing to buy and sell property, allowing them to complete transactions more quickly.

Similarly, the minister confirmed that duty notary offices will complete sales and title transfer transactions during weekends, making it possible to complete these transactions even on weekends. This will help reduce the burden on a large segment of clients who do not have time to complete their real estate transactions during working days.

What is the mechanism for completing real estate transactions under the new system?

Legal and government transaction expert Mrs. Sedef Selçuk confirmed in a media statement to A Haber channel that, under the new system, real estate sale and title transfer transactions will be completed through an electronic system that provides electronic communication between notary offices and the electronic system of the General Directorate of Land Registry, which officially completes these transactions. The notary offices will update property information in the land registry database according to the following steps:

  • The notary office accesses the property information in the General Directorate of Land Registry database to ensure there are no legal obstacles to concluding a sale contract for the property to be transferred, such as a mortgage, legal seizure, or similar issues.
  • If there are no legal obstacles, the notary office formally organizes the sale contract after verifying the payment for the property and collecting the required transaction fees.
  • After the official sale contract is completed between the seller and the buyer, the authorized notary office, using its granted authority, registers the property title transfer transaction in the General Directorate of Land Registry database, thus officially completing the sale process.

It is worth mentioning that the details related to the steps of these transactions, as well as those related to the fees, have not yet been fully clarified. Internal bulletins or regulations on this matter are expected to be issued in the coming days.
